Welcome to the DIAGOMAR PLUS Service (hereinafter the “Service”). The TotalEnergies entity providing you the Service and its affiliates (collectively "TotalEnergies", "we", "us" and "our") take protection of and respect for your personal data very seriously and we are committed to ensuring that your personal data is protected.

By downloading and using the Service, you acknowledge that you have read and understood the Privacy Policy (hereinafter the “Policy”).

The Policy explains how we collect, use and share the information gathered about you through your use of the Service and aims to inform you about the rights and freedoms that you can exercise with regard to our use of your personal data. This Policy also describes the measures we implement to protect this data.

If you do not want TotalEnergies to process any of your personal information through this App, as set out in this Policy, you should not install and use the App.

The TotalEnergies entity providing you the Service is the “data controller” for personal data relating to use of the Service. These processing operations are carried out in accordance with applicable law and are subject to pre-established procedural requirements.

The companies in the TotalEnergies have their own legal existence and have independent legal status. The data controller company belongs to the TotalEnergies. The terms “TotalEnergies” and “TotalEnergies” are sometimes used for practical reasons to generally describe TotalEnergies S.E. (the holding company) and/or its subsidiaries. Similarly the terms “we”, “our”, “us” refer to TotalEnergies, in its capacity as data controller. Any use of these expressions shall not imply any involvement whatsoever of TotalEnergies S.E., nor of any of its subsidiaries, in the business operations or management of any other TotalEnergies company.

1. What personal data do we collect from you

To ensure the protection of your privacy and your personal data, we define personal data as any information that identifies or enables to identify an individual, directly or indirectly, by reference to an identifier (such as an identification number or location data) or one or several factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.

We collect personal data in different ways and this data will be processed in accordance with the purposes described below.

1.1 Data you provide to us directly

In order to use the Service, you must with your consent us with an email address, a login name and a password to create your account.

1.2 Data that we collect automatically

We collect and process to a limited extent and in anonymous and aggregate form, personal data concerning users of the Service, in connected mode. The data collected includes your IP address or your device identifier (e.g., EMEI number), operating system version, the dates on which you access and use the App, user behaviour (such as your interactions with the App), etc.

2. How and for what purposes do we use your personal data

We use the personal data we collect from you for the following purposes:

a) to create your account in the Service;

b) to administer the Service for internal operations including troubleshooting purposes;

c) to ensure that content from the Service is presented in the most effective manner for you and your devices;

d) as part of our effort to keep our Service safe and secure;

e) to notify you when updates for the Service are available and of changes to any products or services we offer or provide through it;

f) to carry out statistical analyses on use of the Service and visit frequency; and

g) to monitor the stability and performance of the App in order to improve it.

 

3. How we share and disclose your personal data

We may share your information with any TotalEnergies entity for the purposes outlined in this Policy. In case of transfer of your personal data outside the European Economic Area, this transfer will conform with any applicable law.

 

4. Where your data is stored

Your personal data is stored by TotalEnergies Belgium in a central database located in Belgium.

 

5. How long we store your data

We will not retain your information for longer than is necessary for our business purposes or for legal requirements. However, please be advised that we may retain some information after you have closed your account with us, for instance if doing so is necessary to meet our legal obligations, such as retaining the information for tax and accounting purposes.

 

6. Your rights and choices

In accordance with applicable local law, you have the right to request access to your personal data, or to modify, rectify, and delete your personal data, and to object to the processing of your personal data for legitimate reasons.

To exercise your rights, please send us your request using the contact details under section 11 below, either by e-mail or by post mail. If you make such a request, we are entitled to request appropriate identification before servicing such a request.

You can also request to close your account at any time by sending an email to rm.tma-diagomarplus@TotalEnergies.com. You should be aware that once the Service is uninstalled, you will not be able to use certain functionalities of the Service.

When you download, access and use the Service, we use cookies and other tracking technologies, as described below.

7.1 What are cookies?

A cookie is a file which records information about how you use your device to browse the Internet (e.g., number of visits, number of pages accessed, etc.) and in particular helps us enhance your visits to the Service.

7.2 Types of cookies we use

We use cookies for several reasons. Some cookies are required for technical reasons in order for the Service to operate, and we refer to these as "essential" or "strictly necessary" cookies.

For example, they may be used to provide a service you requested (language preference, login identification, etc.).

Statistics cookies measure the number of visits, the number of pages viewed, user activity on the site and user return frequency. The statistics cookies used generate a cookie with a unique identifier which has a duration period limited to 13 months. Your IP address is also collected to determine the town/city where you connect. This information is immediately anonymized after use to prevent your identification as a natural person. The traffic statistics data is collected by the service provider and then provided to TotalEnergies in aggregate and anonymous form in a web interface accessible only to the data controller. The data collected is not transferred to third parties, nor used for other purposes. You can block these cookies at any time by using the opt out procedure mentioned above via the link.

 

8. How we protect your personal data

TotalEnergies undertakes to take appropriate technical and organizational measures to preserve the security and privacy of your personal data and, in particular, to prevent it from being distorted or damaged, and to prevent access to it by unauthorized third parties.

10. Changes to the Policy

This Policy was last updated on 3 April 2018. You can find the latest version under the settings menu of the Service. We reserve the right to review and revise this Policy from time to time, in particular to satisfy the requirements of providers of platforms for the distribution of applications. We will inform you about any such change and we will provide you with a then current version of the Policy.
